Form I-290B
To file, fill out the following form: An appeal to the Administrative Appeals Office (AAO); a motion to the USCIS office that issued the most recent decision in your case (including a field office, service center, or the AAO); or certain appeals to the ICE Student and Exchange Visitor Program regarding the refusal of an Immigration and Customs Enforcement (ICE) Form I-17, Petition for Approval of School for Attendance by Nonimmigrant Student.
This form should not be used if you:
Are a petition's beneficiary. An appeal or petition can usually be filed only by the applicant or petitioner. Exception: Only if you are the beneficiary of an I-140, Immigrant Petition for Alien Worker, and we have canceled your approved Form I-140 and informed you that you might file a petition or appeal. You may then file a Form I-290B. With your Form I-290B, please send a copy of the USCIS revocation notice. Do you want to go to the Board of Immigration Appeals and file an appeal? (BIA). The BIA has appellate jurisdiction over appeals of Form I-130, Petition for Alien Relative. The BIA also hears appeals of immigration petitions filed by widows on Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant. Form EOIR-29, Notice of Appeal to the Board of Immigration Appeals, may be used to submit an appeal with the BIA.
Want to use the Adam Walsh Act to challenge a USCIS no risk decision? You can ask for a reopening or reconsideration by filing a request on Form I-290B, Notice of Appeal or Motion, but there is no way to appeal a decision like this.

If you'd want to appeal a Special Agricultural Worker or Legalization application, please fill out the form below. Form I-694, Notice of Appeal of Decision, under Sections 245A or 210 of the Immigration and Nationality Act, is required to be used to file these appeals.
