Form EOIR-29
The local director or the Regional Service Center Directors of US Citizenship and Immigration Services are arbitrating all visa applications (USCIS). The District Director or Regional Service Center Director notifies applicants in writing regarding a resolution adopted after considering visa petitions (as well as canceling or confirming approvals for visa applications).
If the law and rules allow, applicants may appeal the decision to the Board of Immigration Appeals (Board) or USCIS. The petitioner should consult the Immigration and Nationality Act (INA) and the Code of Federal Regulations to determine which organization is authorized to conduct the appeal (CRF).
As mandated by Sections 204 of the INA, the Board's jurisdiction extends to family-based immigrant applications (excluding the petitions of certain orphans). In instances under the Board's authority, applicants must submit the EOIR-29 form. Examining the form's instructions may assist in clarifying the plan of action.
