Form I-864 - Affidavit of Support Under Section 213A of the INA

Form I-864

It is used by the majority of family-based immigrants and by some employment-based immigrants to establish that they have sufficient means of financial support and are unlikely to need on financial aid from the United States government.

Use this form if you are a household member who wishes to pledge that your income and/or assets will be used to assist sponsored immigrants in their efforts to gain entry into the country.

It is necessary to submit Form I-864 with your application, regardless of whether or not your spouse's income is insufficient unless you qualify for an exemption (as detailed below). If your spouse's income is insufficient, you may choose to explore obtaining a joint sponsor to help you satisfy the financial requirements.

Apart from that, unless your spouse has previously filed or intends to file one of the petitions listed below, they must submit the whole Form I-864, which includes the following items:

Form I-130, Petition for Alien Relative, is for immediate relatives, such as spouses, unmarried children, relatives, or parents, who wish to immigrate to the United States

For those whose sponsoring relative owns a 5 percent or greater interest in a business that has filed for your employment-based immigrant visa petition, Form I-140, Immigrant Petition for Alien Worker, must be used.

Alternatively, if your sponsor has already filed Form I-130 or Form I-140 on your behalf, they may choose to file Form I-864EZ rather than Form I-864.
